Food Truck Perks is a service of Clio Assistant LLC.
Who this covers
Food Truck Perks runs giveaways for local food trucks and sends text messages about those trucks to people who sign up. When you enter a giveaway, the food truck named on that entry page is the sponsor of the giveaway. The text messages you receive come from Food Truck Perks, about that truck and the other food trucks Food Truck Perks works with, and Food Truck Perks keeps the information described below. This policy covers the giveaway pages and the text messages.
What we collect
- Your mobile phone number.
- Your first name, which is required to enter.
- Your confirmation that you are 18 or older and your agreement to receive text messages, recorded together with the exact wording shown to you, the date and time, your IP address and your browser's user agent. This is kept as proof of consent.
- Your device's time zone, used only so messages are sent during permitted hours in your local time rather than ours.
- Which entry route you used, such as a code on packaging or a sign at the truck, and, where the code you scanned belongs to a particular location the truck serves, which location that was. This is for marketing attribution and never affects your odds of winning.
- The giveaways you enter, the text messages we send you and whether they were delivered, and any text messages you send to us, including replies such as STOP or HELP.
How we use it
To enter you into the giveaway, to notify winners, and to send the recurring marketing text messages you agreed to receive from Food Truck Perks about that food truck and the other food trucks we work with, which may include giveaway results, location updates and offers. We also use it to honour opt-out requests, to keep the consent records the law requires, and to protect the service against fraud and abuse. Food trucks never receive your phone number.
We do not sell or share your phone number
We do not sell your personal information. Mobile phone numbers and SMS consent are never sold, rented, or shared with third parties for their own marketing purposes. Your number is shared only with the service providers that run the service, listed below, and only so they can do that work. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.
Message frequency and cost
Message frequency varies. Message and data rates may apply. Consent to receive messages is not a condition of any purchase, and no purchase is necessary to enter or win any giveaway.
Your choices
Reply STOP to any message to stop receiving texts. This stops messages from every food truck we send for, not only the one you replied to. Reply START to sign up again. Reply HELP for help, or contact us using the details below. You may also ask us to delete your information, though we retain consent records as described next.
How long we keep it
Your name and number are kept while you are subscribed. If you opt out, your record is kept and marked as opted out, so that we never text you again by mistake; you can ask us to delete your name and the rest of it, as described under your privacy rights. Records of your consent and of any opt-out are kept for at least five years. These are legal records: they are how we show that messages were sent with permission, so they are retained even if you ask us to delete your other information, and even if the food truck stops using the service.
Cookies and tracking
The giveaway pages do not use advertising or analytics cookies, tracking pixels or similar technologies, and we do not use your information for targeted advertising. Our hosting provider keeps ordinary server logs, such as IP addresses and page requests, for security and to keep the site running.
Age
Entry is limited to people 18 years of age or older, and we do not knowingly collect information from anyone under 18. If you believe a child has given us their information, contact us and we will delete it.
Who we share it with
Only the service providers needed to run the service, and only so they can perform that work for us: Twilio, which transmits the text messages; Supabase, which hosts our database; Vercel, which hosts this website; and Cloudflare, which runs our domain and email. They are bound to use the information only to provide their services to us. The food trucks we work with do not receive your phone number or your name, during or after a giveaway. We may also disclose information where the law requires it, to establish or defend a legal claim, or to a successor if our business is sold, in which case this policy continues to apply to it.
How we protect it
Information is held in an access-controlled database, transmitted over encrypted connections, and reachable only by the operator of this service. No method of storage or transmission is completely secure, so we cannot guarantee absolute security.
Your privacy rights
Depending on where you live, you may have the right to know what personal information we hold about you, to get a copy of it, to have it corrected, and to have it deleted. You may also have the right to opt out of the sale or sharing of your personal information — we do not sell or share it, so there is nothing to opt out of, and a browser "Global Privacy Control" signal is honoured by default for the same reason. To make a request, email us from the details below with the mobile number it concerns. To protect you, we confirm the request comes from whoever has that phone, usually by asking you to send a text to our number from it, before we act. We respond within 45 days. You may use an authorised agent, who must show us your signed permission. If we decline a request, you may appeal by replying to our decision, and we will answer the appeal within 60 days. We will not treat you differently for asking. Consent and opt-out records are kept as described above even when other information is deleted, because they are the legal record that messages were sent with permission.
